Thanks for the number. Did anyone else notice drop-outs in the conference? I could only catch bits and pieces of the Q&A session.

What I did catch is Frankel was very tight-lipped about the BDX lawsuit. A number of the questions were targeted at the lawsuit and my impression is that QDEL does have a strategy for handling it and seems pretty confident of its outcome. He gave no indication on whether they intend to settle or litigate, or when he would be able to update us with any new information, however. He also stated the lawsuit could affect 70-80% of their current sales. One question asked if QDEL might counter sue for the damages BDX has already done to QDEL's business. Frankle refused to answer.

I think it's safe to assume that they're working with BDX on a settlement, but are also formulating a litigation strategy for backup and to leverage their negotiating position.
