Tec - I only meant that the S&P addition created a one time circumstance where the arbitrage margin probably did not accurately reflect sentiment regarding the merger. I agree with you that there are legitimate DOJ concerns. The arbitrage margin during the ETEK merger did tend to increase and decrease independently of DOJ news, however. If the market was moving up, the margin narrowed as people were just generally more confident and if it was moving down fear ruled the day and it widened.

First mover advantage is a religion of John Roth's and I expect his first choice will be to take advantage of the merger to do some very tough negotiations to guarantee supply for NT rather rather than trusting NT's supply chain to the tender mercies of the DOJ. Roth has also made it crystal clear that he does not want NT to be in the manufacturing business. Kicking up a big stink over the JDSU/SDLI merger with DOJ would just muddy the waters for any future plans he has for NT's optical component manufacturing business. I tend to be much more concerned with complaints from companies who might see competitive advantage in using the DOJ as an effective delaying tactic. - peggylynn
