How is it different? Gilder puts out a newsletter in the mail, arriving in mailboxes at different times on different days. Elgindy is on the phone, IM'ing on the internet, and his posse can act within MOMENTS of one another to instantly depress a stock.

It's simple, clear, easy to understand english.

Read section 9 and read it over and over until you understand the implications. CONTEMPORANEOUS buying or selling with knowledge of others doing the same is a CRIME. When the players know one another and conspire to short the same issue, it appears to be a CRIME.

Anyone conspiring to short with others at substantially the same time at substantially the same price may be guilty of FRAUD by reason of price manipulation.

There can be no arguing this point as it is described in detail by the SEC in the Securities Exchange Act of 1934, Section 9.
