My first reaction to Lexar's statements about how they intend to work around SNDK's patents before the trial ends, is that they mean to create a reason for yet another trial. If Lexar claims to have circumvented the patents, the judge may well decide on a penalty due for past product sales and leave it to SNDK to bring suit for future offenses.

This type of legal manuevering gives Lexar's manangement time to cash out their options before the bankruptcy hearing. On the other hand, Lexar may actually develop a way to circumvent SNDK's patents. If there is even the smallest chance that this might occur, then it would be incumbent of SNDK to buy Lexar at most any price, so as to protect the value of SNDK's IP and existing royalty agreements.

When you have nothing to lose and smart lawyers, you are a dangerous foe.
