I think this quarter will tell us how strong SanDisk's legal position against Lexar actually is. If there are new CF assembly licensees announced during the Q3 conference call (and Eli suggested that other card manufacturers are seeking such agreements in the wake of Lexar's legal defeat) it would seem clear that Lexar has a weak position indeed.

SanDisk could also go for an injunction that would force Lexar's new and improved controller into mass production. At that point the bluff is called and we will see what kind of hand Lexar is holding.

To magically pull a rabbit out of your hat after 2 1/2 years of protracted legal maneuvers seems a bit improbable. All that aside, there are court documents that suggest that Reimer admitted that Lexar infringed on SanDisk's technology. That could easily spell "willful infringement" in the mind of any reasonable individual given the fact that SanDisk ex-employees make up a portion of Lexar's management.

Lexar Media is the sacrificial lamb and an excellent target for sacrifice given the history of the company.
I don't think it is any accident that it is the first and only CF assembly lawsuit to be tried in the US.

Lexar Media is running out of time "do the right thing". I hope that the October trial date happens before the Lexar CEO's lock-up expires. It will be a strong impetus for settlement. If the lock-up expires before the October start date it will be interesting to see how brisk the insider selling actually is.
