How would you go about investigating or documenting such a charge?

Seems to me you'd have to initiate a suit and get auditors to get records under discovery rules. All E*Trade has to do is demonstrate that systems genuinely broke down.

Without a law firm willing to work on contingency, I doubt this is going to go anywhere.
