Charles - the press about the NDAs was unfortunate but the NDAs themselves are standard practice and have nothing to do with "sweeping things under the rug". Early on in the process of identifying a problem, engineering may provide various pieces of technology which are not public, such as OS source code, which might need NDA protection just to keep the customer from say publishing the fixes on the web... careless handling of that material can inadvertently put intellectual property in the public domain. These NDAs are really designed to let the engineering teams work freely without worrying about arcane legal issues. What I thought was needed was better info from SUNW on the nature and purpose of their NDA agreements.
