Leland, your points are well taken, but my views were based in part on an article in the Aug. 31 New York Times, which indicates that one of the results of the trade secrets litigation was evidence that BRCM may have infringed some INTC patents. Put another way, people who had worked for INTC and were being considered for employment at BRCM, may have divulged certain information concerning INTC patents, or possibly ways of circumventing the patents. This creates a dispute about whether BRCM infringed any patents, and how they were able to do it, or avoid doing it. It might even end up as an either or situation, where, if BRCM didn't infringe, it may have used trade secrets. Or vice versa.
