see my political argument earlier. Justice probably realizes that the cure is worse than the disease and that they will probably lose the appeal anyway. For MSFT settlement ends this NOW without the spectre of another year or more in Appeals. Good outcome for both. Why is this a surprise? It's the appropriate thing for both sides to do.
