Yes, some lawyers are proactive, and so is almost any good businessperson. Do you fault Intel for being proactive? You have a bias against litigation, so being proactive becomes a negative. In the mental retardation situation, if doctors had been proactive and advertised a cure (that would also make the doctors money) would that be bad?
Lawyers are nothing but craftsmen implementing the laws that society uses to influence behavior. You can't blame the lawyers for litigation any more than you can blame the undertaker for death.
Now government, thats another story. The country, every state, every county, every city has law making bodies. At this point in US history, haven't these folks written enough laws yet?
