Jay,

I have read about the following line of argument...

If the Recording Industry can show that CD sales have lagged since Napster was released their case will be even stronger. It will be important to show to the court that Napster has this type of effect on retail sales of CD's.

If CD sales have increased despite Napster's release I think Napster has a chance. That is, Napster's attorneys could argue that Napster actually facilitates new CD sales by increasing listener interest in newly released music.

I think either way SanDisk is positioned to benefit. I do believe there is more money to be made on the unrestricted use of MP3 as adoption of security mechanisms may dampen interest in SDMC, at least initially.
