It is true that the moment of silence is a proxy for the overt prayer. However, it is not a prescribed prayer, no matter how you parse it. It allows the virtual observance of custom without any serious imposition on anyone. We did not have a theocracy in 1961, a year before the ban on school prayer. Why should a moment of silence matter?
