I have to say, I don't quite see the difficulty. Aside from the fact there is no physical distribution to control (ie. you can't be required to physicall return a download or pay extra rental), it isn't hard to see how, with proper encryption, it would be possible to have downloads expire after the rental period is up.
Sure it could be hacked. Sure there'd be those who'd do that, and sell it on the blackmarket, so there'd be some 'leakage'. But the reality is it's like software: ya fight the piracy, prosecute the pirates, and make bundles of money from all of us who will/do play by the rules.
As far as the royalty splits, how or why would it have to be any different than videos or DVDs? And man, I'd love to avoid having to go to the video store, but not have to watch the movies only when they happen to be showing on PPV, without being able to pause them, etc.
