Silence imposed by government fiat does matter.
If a "moment of silence is a proxy for the over prayer", as you say, then it indeed violates constitutional proscription of establishment of religion. It does more than "allow the virtual observance of custom", but rather provides government blessing and enforcement of religious custom. And what for you may not be a "serious imposition" because you agree with the reigning religion, may be to others. Let people pray (or be silent) in private. Government should be out of it.
