You must not be familiar with out "lovely" court system...
You can sue for anything.
Often, deals are just struck to minimize costs of litigation...basically damage control.
So if RAMBUS makes the royalties low enough, the DRAM makers may just go for it rather than fight....knowing that down the line, sooner or later, the memory architecture will evolve and they will be rid of Rambus...
Still, it would be interesting to see it really tested.
