Judge dismisses suit against gunmakers

CHICAGO, Sept. 15 (UPI) - A judge Friday dismissed the city of Chicago's suit
against the gun industry, saying it had not proven the industry is responsible
for gun violence.

Mayor Richard J. Daley vowed to appeal the decision to the U.S. Supreme Court,
if necessary. The county said it would join the city in its legal effort.


Circuit Judge Stephen A. Schiller in February ruled he found no basis in law to
support the city's claim of "negligent entrustment" against the gun industry.
Schiller reserved judgment on whether guns are a public nuisance.

The city withdrew the suit after that ruling and then refiled it in March,
loaded with supporting statistics. The revised suit claimed in part that
licensed gun dealers knowingly sell firearms to people they know will resell the
items to those who cannot buy weapons legally.

"We need the same authority to take away the licenses of gun dealers as we do
for liquor establishments," Daley told a news conference at police headquarters.

The suit sought $433 million in damages.

Attorney James Valentino, who represents one of the 38 gun shops named in the
suit said the ruling was what "I hoped for," adding, however, "we must
understand this case is not over."
