The way legal cases are handled are not solely a matter of constitutional law. So your linking them is an obfuscation. The way in which plea bargaining works and cases are handled are up to the inner workings of the court. When you have lawyers making rules for lawyers. It's like asking the fox to guard the hen house.

I'll give you an analogy. We've had some problems related to the stock market and trading practices. So we've passed laws curbing brokerage house freedoms. All types of things have been passed and are now enforced by the SEC. Who enforces the lawyers ethics? The BAR? The courts? Would it have been reasonable to do nothing in regard to certain types of trading practices? Would it have been right to say to brokerage houses, handle this without outside intervention? Of course not. Having the fox guard the hen house obviously leads to abuses.

That's basically what we have today. Lawyers can lie, cheat the system and very little is done to stop it. Do you see a trend taking place within the legal profession to start enforcing ethical standards now? I certainly don't. Debating whether Clinton should be disbarred or not should have been a no-brainer. Committing perjury is a crime. Case dismissed.

Therefore, reasonable laws curbing abuse should be enacted from the outside, because we can't trust the legal profession to do it themselves any longer. They've made their bed, now they must lie in it.
