He doesn't have to do anything if he stays quiet. The thing about ML research is you can "shop" around to get your report approved for publication. If he publishes something without an upgrade you'll likely see one of three things: 1) no mention of a price target; 2) reduced 12 month price target; or 3) price target switched from 12 month price target to 12-18 month price target.

Niles' silence is interesting. One scenario under which an analyst is silent is when he is brought over-the-wall in regard to a banking deal. Then because the analyst may know privileged information, he is shut down until the information is publicly disseminated. I have no idea what the circumstances are with regard to Niles.
