Yeah, I read that too. Strangely enough, those particular statements that you quote could not technically, without more, be a violation of the law.

These are statements of or opinions of future events. Since no one can know the future, it cannot be a statement of fact upon which one could justifiably rely. They are opinion. Since they can not be "true", they also cannot be "false".

All in all, a very interesting case.
