A post-election indictment would not be all bad.
You think the prosecutor has the stomach for a fight with Clinton's lawyers when Clinton is no longer hand-cuffed by the political demands of being President, and the public relations of this election? Could put to rest once and for all the question whether this was a politically motivated witch hunt, or a true pursuit of justice (yeah, right). I would hate to be the judge in the case.
