Kevin I certainly have never seen this before.

I'm not familiar with the precise terms of the bank debt, maybe they have a grace period after today during which they are not in default.

But some of the debt was already extended from Sept.2 until today, and it seems to me that would definitely be a default if not taken care of today. Also, there is the question of whether such a default would trigger covenants in other debt.

And the company is just REFUSING to say whether they are in default or not?

I didn't know they can do that!
