That's not what you said before. You said:

The quoted language indicates that there can only be a default if the creditor affirmatively claims one.

Now, you say that the language of the contract determines whether there has been a default (which I agree with).

Those are two different things. If the contract says that non-payment is a default, the creditor does not have to take any affirmative actions to trigger the default; it is the debtor's non-payment that triggers the default.
