If the argument is that Napster is like a web hosting company that isn't responsible for the content of the web sites that people put up, then it might get away with a little bit. But knowingly putting up copyrighted material on one's website is illegal, and so the people using Napster to distribute copyrighted music are doing something illegal. If Napster is knowingly facilitating this, they are a party and should also be made to reimburse the artistes and their agents for each download of a song.
