If that was Att's intent, they never would have pursued the ownership of ATHM to the extent they have.

Also, Att and MSO own the last mile, so this possibility always exists. This is one reason why the market has put so much emphasis in the past on exclusivity agreements.

Why bother with the superfluous bifurcation? The bifurcation if it is so critical to OA can be done in other ways like bifurcating distribution and presentation.

ATHM provides a good service to MSO by handling all those details of delivering a final product. This functionality is achievable equally well if ATHM was a division of Att. There are regulatory reasons blocking that possibility and there is no added value for the added risk and cost in that arrangement. Att is in no mood currently to go there.

Finally, the exclusivity agreements have been extended out to 2006 and 2008, but they aren't and never were all that critical. Just who is getting into the cable "space"? No one wants to do that because it's such a mess. ATHM has a monopoly and like the salt industry, no one cares. They only care when you make munnee. Then government has to hurt you to make sure you don't think you're better than the rest of us.
