A well formed H&S pattern has equal length left and right shoulders. The right shoulder is not well formed. It is possible that, with time, a good right shoulder will be put into place.

The only thing lacking is a well-defined neckline, although I think 10,000 is for many reasons the important support level. If it is broken decisively, I'll consider a broken H&S top formed.
