johnd--MSFT and the DoJ have now submitted proposed briefing and argument schedules. Now, we will get our first glimpse of whether the appellate court will have the knee-jerk pro-MSFT bias that almost everyone seems to expect. My prediction: the appellate court favors the DoJ proposal. The market yawned when the Supreme Court declined to take the case prior to the appellate court, since virtually no one expected they would. What happens when the appellate court surprisingly issues its first anti-MSFT ruling? Stay tuned.
