Primus is under FCC investigation!. Just found it over Yahoo Message board!

I just got a letter from Mr. James W. Tomlinson,Director of Regulatory Affairs and confirmed that FCC is investigating Primus's business fraud. I filed a complain to FCC earlier to complain Primus's tele-marketing as well as general business fraud. I also attached a letter I sent to FCC today in respond to Mr. Tomllinson's letter to FCC. If any of you are Primus Customer, you shall check your phone bill and to make a complain to FCC as well if there is any over-charge by Primus in the bill. I am planning to bring Primus to a California State Court and may ask class action lawyer to take a consumer fraud class action against Primus.
Anyone can call Primus to verify FCC investigation.

Dear Ms. Bowers:
I have reviewed and investigated the referenced complaint, in which Mr. AA complains about an alleged rate increase. In response, Primus strongly denies Mr. AA hyperbolic claims of "fraud and cheating".
Mr. AA joined Primus under a promotional rate plan that offered rates of $0.399 permute for calls to China for a period ending May 1, 2000. Primus's FCC Tariff No. 1, Section 8.49 provides that the promotional rates are offered only to new customers and that customer would be changed to Primus's Globe-Talk Plan BC tariff rates on May 1, 2000(0.499 per minute for call to China). Primus never promised to maintain these rates at promotional level, or to move Mr. AA to another rate plan after the promotional period expired, as he claims. Nonetheless, Mr. AA has refused to pay this outstanding account balance despite the fact is that, as a good faith gesture, Primus has credited Mr. AA's account for the rate difference for May 2000 calls.

Dear Ms. Bowers:
Thank you very much for investigating my complains to business practice fraud by Primus Telecommunication, Inc. I just received a copy of a letter by Mr. James Tomlinson of Primus to you regarding to my complains. After reading Mr. Tomlinson's letter, I am deeply troubled by Primus's business practice, including mislead your Federal Communication Commission.
There are few facts I would like to emphasize here to show how Primus misled consumers as well as your Federal Communication Commission.
1). When I joined Primus last year, Primus's tele-marketing people never told me that the plan I was getting was a promotional plan. They never told me that the plan would be ending on May 1, 2000. They never told me that I would be charged at a rate 45% higher than their published rate after May 1, 2000. Instead, they told me that I would be charged at the lowest rate all the time, if there was any rate reduction within the company, my rate would be reduced accordingly. If they had told me that I would be charged 46% higher than their published rate, would I join them? Just from common sense, we know PRIMUS was cheating and mislead its customers. We also know Mr. Tomlinson of Primus is even trying to mislead FCC as well. He just simply cannot face the common sense and the facts. Primus's published rate for China is $0.299/min, however I was charged at $ 0.399/min and $0.499/min respectively, upto 46% higher than the published rate..
2). Was $0.299/min a promotional rate instead of Primus's Current Official Published Rate? The answer is either NO or PRIMUS is misleading public again. I am sending you a copy of Primus's published rate indicating $0.299/min for calls to China, there was no "PROMOTIONAL" word there. If this $0.299 /min rate was a promotional rate only apply to new customer, if the rate would be increased to $0.499/min after the new customer joined Primus as Mr. Tomlinson claimed, Primus shall indicate these terms on their published rate sheet instead of misleading consumers. Primus again is misleading consumers. . This further showed that PRIMUS's business interests are not to serve consumers well, but to mislead consumers and making money by cheating and fraud instead of providing qualify services to public. Their tele-marketing people misled consumer to join them and then they charge them at the rate 46% higher than their published rate . If they can mislead me by tele-marketing fraud and charged me at 46% higher than their published rate, they must have done the same to thousands of consumers already. This kind of business practice is a fraud and cheating . .I would like to ask FCC to stop PRIMUS doing this kind fraud to protect consumer's interests.
3).. They over charged me more than $150 dollars but they only agreed to credit me $4.30. During my dispute with Primus, Primus never sent me anything to explain the over charges. Their customer service often hang up the phone and never gave me an answer. They constantly harass me and even asked collection agency to harass me as well while I am disputing the charges and filing my complains to FCC and California State Consumer Protection Agencies. Their collection agency even harassed me today. These behaviors further showed that PRIMUS's has no interests to serve consumers well, their only interests are making money from Consumers not by good service but by cheating and Fraud. I would like to ask FCC to investigate PRIMUS's such business practice fraud in detail and to take action against them.
Currently, I am disputing their OVER CHARGE of $66.10(only for over charge in April and May, actually they over charged me more than $150 in Feb., March, April. And May, 2000, I might dispute these charges later if it is necessary).
In Short, the amount of money I am disputing is not important, stopping the illegal business practice by PRIMUS is more important. I, AA, Ph.D, an excellent and lawful tax payer, and a consumer, would like to ask you, Federal Communication Commission, to take action to protect consumer's interests, to stop Primus Telecommunication's business and tele-marketing frauds. I would like to ask you to investigate how much money PRIMUS has made by such fraud scheme from its customers and to impose a fine to PRIMUS to protect consumer's interests.
