Punitive damages should go to the party that sues for them. The state rarely sues on behalf of the people -- as in tobacco -- but is free to do it and should.
If lawyers charge to high a contingency fee, it is evidence that there are not enough lawyers competing for these cases. In a free market with competing lawyers, the plaintiff could obtain lower fees. Economics 101.
