"Unfortunately, much of this “information” comes via “new technology” (meaning its sources are hard to trace) and we can say, with a high degree of confidence, that much is being generated by short sellers who economically want Conseco to be in continual distress."

A couple of points:

(1) By blaming CNC's problems on "hard to trace" sources of information, Gary is clearly referring to anonymous message board posters (TSCM and Rocker Partners are not the least bit "hard to trace").

But why is Gary having so hard a time "tracing" these sources of information? For $10,000 in legal fees he could file suit, serve subpoenas, and "trace" these sources of information. So, **** or get off the pot, Gary.

(2) If this letter was either originally or subsequently posted on the internet by a Conseco employee, CNC could be facing some serious liability. When CEOs tout their stock, either directly or indirectly, via public message boards, bad things happen.

I intend to forward this letter to the SEC, and they can then trace its source and determine whether there have been any violations of law.
