texas has nothing to do with the collection of sales tax by other states. any state has the legal ability to go to any company, even if not incorporated in that state, and audit the books and demand payment of sales tax for product sales within their state. the only exclusion is for corporations / endusers with tax exempt, resale or direct pay permits. the ultimate responsibility is to the buyer of the item, but the collection procedure is mandated to the seller. it is an unwise game for a company the size of dell to be playing....their peers all collect sales tax.
