I guess in your scenario, it's been in an uptrend, and then pulls back. Then it goes for a test of the last high. A test of top in this setup is a test of the high of the uptrend. A bear flag is a continuation/consolidation pattern in a downtrend. That's the difference between the two, a la the classic definition of Edwards and Magee.
