I'm not sure about that, a threat can be written or implied.
In the context of a thread like this such banter may easily construed as a threat to sue. To me that very dirty pool and I don't take kindly to it. It's basically a cop out and cancer on US society, IMHO. And really, now one may be able to see the problem with Rambus' business model and why so many in the industry are so upset about it.
