SanDisk still has the option of filing an injunction.

The Lexar registration statement says this could
happen at any time, if I recall correctly. (Then they
would be forced into releasing their product with the
new and improved "design around".)

I doubt that SanDisk resort to this, because I think Eli
is more in favor of promoting CF than trying to force
people out of business and limiting consumer access to CF.

They could certainly start taking actions as if they were
proceeding with an injunction in the hope that Lexar would
capitulate. Well, I guess we'll have to leave that up to
SanDisk legal to decide.

Anyone have a rough idea how long a patent nullification trial
can go on? Do they just review the expert testimony and
judge's ruling on the infringement, or is additional evidence
entered and we start the whole thing over from scratch?
