Because I gather that Eli and Co. are trying to play "Not to Lose" instead of trying to WIN. Sandisk is probably very concerned with trying to keep any bad press whatsoever out of the newswires. Sadly, this is not how business operates these days. You need flash and gross distortions and exaggeration to get your point across in this environment of information overload.

If I were in charge of Sandisk, I would immediately hire a bunch of pit-bull New York lawyers to fire off 2 well-publicized lawsuits accompanies by press releases per day aimed squarely at destroying any credibility Lexar has left- press releases disguised as news items with titles such as "Lexar Bankrputcy Around the Corner?" or "Lexar's Court Litigation Practices Called Into Question." or "Lexar Patent Infringent Case Going Badly Aganist Sandisk."

As we see with Lexar's strategy, it doesn't really matter if the lawsuits are basically without merit. And so what if Sandisk takes a short term hit in credibility? The average attention span is so low these days, all people will remember in the end is that Lexar is going out of business and they and their products should be avoided. And the name Sandisk will get more exposure period than their current strategy of waiting for Lexar to take their heads off and only then try and repair the damage.

I'm talking 2 releases per day from Sandisk, every day with malicious titles just like Lexar is allowed to get away with. You have to fight fire with fire, and right now in Wall Street perception, Sandisk is getting its teeth kicked in by Lexar.

another press release could be:

"Sandisk Plans for Re-Modeling Lexar's old Office Space following Lexar Bankruptcy."
