Re: what will carry more weight, what NEC and Hitachi "wanted to do" or what "they actually did". A litigant can settle without admitting guilt and without prejudicing future cases. The tobacco companies did it repeatedly for 30 years - though (since they were very clearly guilty) they eventually lost in court. The verdict isn't nearly as clear with Rambus - but feel free to wait 20 or 30 years and see! Dan
