Here's the reply I received in response to my query:

The wash sale rule applies to all investors (including corporate investors), and also applies to individual and corporate traders that have not made the mark-to-market election. It doesn't apply to dealers. If Merrill Lynch, in its capacity as a dealer, has a wash sale, the rule doesn't apply, but the rule generally does apply to taxable institutional investors. If there's some reason it doesn't apply to a mutual fund, I'm not aware of it. I've never seen any discussion of this issue on the web or elsewhere.
