My guess is that Intel will make sure DEC is the last company on Planet Earth to ever see a Merced chip.

Intel will defend their name, reputation, devices and patents straight-up against DEC's law suit. If they (Intel) haven't used (even inadvertantly) DEC's patents, they should not give away the crown jewels just to avoid a protracted legal fight.

Let's face it - DEC's "Ten Patents" ARE NOT FUNDAMENTAL PATENTS. If they were, DEC would have publicly announced these years ago and would have demanded that ALL CPU manufacturers insure they are not using DEC's patents. DEC didn't invent cache controllers, translation look-aside buffers, etc.

More than likely, DEC has some usage patents that apply to specific implementations of cache control logic, etc. Proving that Intel violates these patents will be no slam dunk - assuming that the patents are even valid. All this still has to be decided.
