So then it looks like the worst case scenario that could come out of the Oxford case is that Affx has to pay $120 M. This would hurt but wouldn't be the end of the world. At any rate, even if Affx were forced to pay, a rate of 25% seems excessive. But their objection that the patent is invalid due to prior art is an interesting one. DOes anyone know when this patent was filed. Off hand I'd guess the first Southern Blots were late seventies, but I'm not really sure.
