In 1998 the FL Supreme Court set the standard for conducting an election again. If there are 1) substantial irregularities 2) that are material and 3) the will of the people is not reflected in the result then it is proper to hold another election.

The Palm Beach case easily meets this standard. The ballots are in violation of law. 20 thousand voters were denied the opportunity to express their will and the votes are of course material to the outcome.
