Weather it fails or not is not the issue. The time to challenge it was when it came up for review before the election. They had two shots at this one as it was used in 96 also. There were the same issues with it after the last election, but the party that is challenging it won that time so the same ballot was ok in 96?

The bottom line is there are processes in place that try and make the ballot fair. This one passed those processes twice. If the ballot is not fair they will have another chance to change it next election. There is no precedent to call a re-vote.
