The 20th Amendment doesn't specify. I was speculating that Denny Hastert, Republican Speaker of the House, might get the job because we don't know yet whether Republicans will have a majority in the Senate or whether it will be split 50-50. I am assuming that first the House would vote and then the Senate would vote. Once Gore stands down from the office of Vice-President on January 20, 2001, he won't be available as a tie-breaker for a tie in the Senate. So what the Senate would do would depend on whether there was a tie or the Republicans had a majority. If there is a tie, then I think they'd appoint someone acceptable to both parties. If there is a Republican majority, I think they'd appoint Bush.
