Tim, the constitution also contains all this stuff about "unreasonable search and seizure". A lot of attention was paid to that before the Warren court. In NY for example, the police never bothered with search warrants. A lot of attention is paid to that part of the constitution in the war on drugs too. Possession of large amounts of cash is considered sufficient evidence of drug dealing that the cash can be seized, and it's up to the seizure victim to prove that it shouldn't have been.

There's always been interpretation involved. That the interpretation these days is sometimes slightly less skewed toward the government than it has been historically is an odd subject for conservatives to whine about.
