I think the Presidential Succession Act would control, and in the case of the failure of a Presidential candidate to qualify, and in this case also the failure of the Vice Presidential candidate to qualify, the Speaker of the House would become acting President. But the 20th Amendment does provide that Congress can appoint someone else. I expect they would stick with Hastert if, by some unfortunate circumstance, this matter is not resolved expeditiously.
