The statute says the canvassing board "may" order a manual recount. So it's discretionary, but I think there probably has to be a good reason, since discretion is never unbridled. I expect that Dubya is protesting the fact that the canvassing board will examine the ballots to see if they can divine the voter's intentions by looking at the ballot. Even though there will be both parties present, this will obviously be subjective, and if the counting team is unable to do so, then the canvassing board has the final say. In Palm Beach county, the canvassing board is Democrat, as are all the judges, and, indeed, most or all of the appellate judges. The federal bench, on the other hand, contains quite a few Republicans and conservative Democrats.
