My post must not have been clear. We do not disagree on this point. The judge clearly has tipped his/her hand, but not with regard to whether or not he/she will rule in favor of Bush. The judge is essentially saying, "Do you have to do this?" Come Monday, I don't see why the judge cannot invalidate any hand-count done over the weekend if it were indeed legally invalid (I have no idea what the law is in this regard). Also, presumably the federal judge has jurisdiction, if he/she so chooses, to stop the other hand-counts that will not be completed by Monday morning. So I'm not sure that the application for TRO is entirely moot, but IMHO it will certainly be withdrawn if the weekend hand-counting does not discovery major discrepancies.
