On the legal dimensions of the recount. It is a FACT that under Florida law, the hand recounting of votes is permitted. The relevant statute vests substantial discretion in the eye of the evaluator of each ballot. I have little doubt that the hand count in Palm Beach Cty will result in a substantial increase in Gore votes. The important point is that the Republican lawsuit, to be argued tomorrow in FEDERAL court, is a (federal) CONSTITUTIONAL challenge to the FLorida statute. In other words,the hand recount is PERMITTED by Florida law. The Republicans are arguing that FLORIDA law is UNCONSTITUTIONAL. No matter what the outcome of the case, one side or the other will appeal it. This will drag on and on UNLESS Albert Gore concedes the election after completion of the count of absentee ballots.
