The theory of the case is Equal Protection. The cited statutes track the language and substance of the 14th Amendment. Equal Protection IS a civil right, one protected BOTH by statute and the text of the Constitution (specifically, the 14th Amendment). Thus, it is most accurate to state that the case is brought BOTH under federal statutes and the US COnstitution. Thanks for posting the link to the Complain. I had not yet seen it.
