The problem for the Bush team is that they banked on the federal judge hearing this on an emergency basis on Sat. and they allowed the deadline to request a manual re-count in a great majority of Florida counties to expire. So, they are going to have to go to state court to seek a waiver of that deadline. They've already implicitly asked the Gore camp to waive the deadline for the sake of fairness. As if the Gore camp could waive a statute! If they lose in court on the federal injunction and then take whatever next step they think of, it is going to look like they are being sore losers.

Tomorrow will bring about another chapter in this soap opera. Not the final chapter though. I believe the federal judge already tipped his hand by deciding not to hear this emergency motion on an emergency basis. I can't believe a federal judge would allow the counties to expend the energy they have had to expend on re-counts which he is going to stop.

Is my opinion neither team is winning the PR game but the Bush camp is losing the legal strategy game. I would have picked a better fight to fight than fighting the constitutionality of a state statute which has already benefitted Bush in this election in Florida and New Mexico.

It's a real shame that this is happening when all the good news is coming out on qcom. qcom would be much higher now even in a neutral market.
