It's impossible to prove that the ballot is the sole cause of the voters' confusion. Thus it is impossible to prove that the ballot is the sole cause of the harm. I'm not sure it's even possible to prove that any part of the harm is due to the ballot design. That reasoning is yet another attempt to deflect cause away from the person casting an incorrect ballot and onto anything or anyone upon which blame can be laid.

Four years from now I will run for president as an independent. The main platform of my ticket will proclaim that nobody will be held respsonsible for anything because everything is somebody else's fault. I won't get elected because nobody will be able to decide who the winner is. But nobody will be elected, and that's surely gotta be a better outcome than the choices we're usually given.
