Two separate issues. There's a 72 hour window to exercise your right, your option, to request a handcount. The Democrats were timely; the Republicans were not. Unless, of course, the Republicans wish to change the rules. I do take note of their public relations campaign to distort this issue, claiming all counties should be counted.
Regarding the Dems request to be allowed the time to enable the handcount, the court will rule if you're going to grant the right to the act of a handcount, time sufficient must also exist in order to complete the act of the handcount. This is simple logic, simple law. In my view, this extension will easily be granted the counties, who only want to count the votes of citizens.
It's also noteworthy that the law, as dedicated to the Secretary of State, indicates the secretay "may" extend the deadline. Were the secretary truly non-partisan, an extension would be easily granted thereby avoiding the need to petition the court.

Actually, one could argue it's politics at its best. Depends on what moves you make in the chess game. This sorta reminds me of when Fisher gave up the piece, not to win the game but rather to win the match since doing so psyhologically drove Spassky nuts. Fact is, the Dems have played a better game within the rules. |
